My Take Aways
The Case Against Donald Trump.
At this point, the only thing keeping Donald Trump out of jail is uncertainty. Can we find 12 people anywhere in the United States who would all vote to convict Donald Trump. About 30% of American’s still consider Donald Trump king of America. It will not be easy to find a truly impartial jury. For this reason alone Merrick Garland needs to be extremely thorough. Up to this point I applaud his patience.
Donald Trump’s view on lying. “If you say it long enough, hard enough, often enough, people will start to believe it.” This is why Donald Trump still repeats the “big lie.” He has to have people continue to believe him, even with a huge body of evidence that it is a lie. Donald Trump’s own words tell us he lies and repeats his lies to make others believe his story.
The case is substantial.
The Prosecutor’s Summation Might be as follows:
Did Donald Trump know he had lost the election?
He was told multiple times by high placed staff members that he had lost the election. Attorney General Bill Barr and White House Counsel Pat Cipollone and his staff, the Georgia Secretary of State Brad Raffensperger and others, all told him he had lost.
By the time the electors voted in each state, the courts had spoken. All but one of his 61 cases were dismissed without merit. Many of these cases were dismissed by judges appointed by Donald Trump.
The courts decided that there was no widespread fraud.
The electors had voted and any attempt outside the courts must be considered treason.
Answer: Donald Trump knew he lost the election.
By mid-December, Donald Trump still failed to publicly recognize the results and now focused on illegal means to overturn the result.
Where did Donald Trump Turn
When Donald Trump’s appointed advisors refused to recognize election fraud, he choose to get guidance from others outside the government. A meeting was held on December 18, 2020 attended by Gen. MIchael Flynn, Sidney Powell, Rudy Guiliani, former Overstock.com CEO Patrick Byrne. Members of the White House counsels office were also in attendance. The meeting was contentious to say the least.
At the conclusion of the meeting, Donald Trump sent out a tweet inviting his supporters to Washington for a “Big protest in D.C. on January 6th. Be there, will be wild!” This triggered a series of events leading to the January 6th invasion of the US Capital.
It galvanized conservative white supremist groups, such as the Proud Boys, Oath Keepers and others to work together. These groups came to Washington with the soul purpose of starting an insurrection. They felt Donald Trump’s tweet was a call for violence.
In addition, it was quietly leaked that Donald Trump would invite his assembled supporters to march on the Capital as part of his speech.
Steve Bannon after speaking to Trump provided this quote on his podcast on January 5th. “All hell is going to break loose tomorrow, It’s all converging, and now we’re on, as they say, the point of attack.”
Donald Trump Meets With Members of Congress
From his speech we also know he invited them to march on the Capital. His warnings indicated to be strong. Only on one occasion in the speech did he request this crowd to be peaceful.
Obstensible the purpose of this meeting was to organize challenging electors from battle ground states. This by itself was a legal process, but Donald Trump had gone further.
The Eastman Plan
The plan devised by John Eastman was a 6-step plan.
Trump supporters met on December 14th in 7 battleground states. These meetings held in extreme secrecy consisted of Republicans posing as electors. They signed alternative electoral ballots supporting Donald Trump, instead of Biden.
The plan was for Mike Pence to recognize the “fake electors” votes instead of the votes by the legal electors. At a minimum that would cause a crisis which would then turn the election into the House. Where the Constitution defines that each state only has 1 vote and Republicans hold a 26 – 24 majority. Donald Trump would still be president if this plan had worked.
Eastman admitted his plan would be denied 9-0 by the Supreme Court. The plan hinged on Mike Pence. Ultimately he refused to support this effort. For his refusal Mike Pence became a target of the mob on January 6th.
Donald Trump and the Department of Justice
The hearings have shown that Donald Trump attempted to pressure the Department of Justice into supporting his “Big Lie”. Again his attempts failed. This was up to and including his attempt to replace the Acting Attorney General Jeffrey Rosen and replace him with Jeffrey Clark. This plan failed when it was clear that every DOJ department head would resign.
Donald Trump knew the Mob was armed.
Cassidy Hutchinson confirmed that Donald Trump, knew the mob was armed. The other highlight is a fact undisputed, that Donald Trump’s security detail refused to take him to the Capital. Early in the Capital attack, Donald Trump did nothing. He reportedly supported the mobs suggested punishment “Hang Mike Pence.”
Donald Trump sent his mob to the Capital on January 6th.
Long after briefly uttering the word “peaceful” just once.
In the summary of his January 6th speech, Donald Trump sent his mob toward the Capital as follows: rs with the words: “And we fight. We fight like hell. And if you don’t fight like hell, you’re not going to have a country anymore.”
and.
“So we’re going to, we’re going to walk down Pennsylvania Avenue. I love Pennsylvania Avenue. And we’re going to the Capitol, and we’re going to try and give. … We’re going to try and give them the kind of pride and boldness that they need to take back our country.”
Summary
Donald Trump.
- Knew he had lost the election.
- Devised a plan to overturn the election.
- Invited a mob to Washington on January 6th.
- Stoked the mob’s emotion to make them angry.
- Sent the armed mob to the Capital.
and when he finally told them to leave.
Made a point of saying. “So go home. We love you. You’re very special. You’ve seen what happens. You see the way others are treated that are so bad and so evil.“ Even then Donald Trump showed his support for the events of the day.
So if given the chance.
